SUBJECT – SCOPE

These general conditions of sale are intended to define the rights and obligations of the parties in the online sale of the articles offered to the CLIENT on the Site.

The Ordering of an article on the Site implies the acceptance without any restriction or reservation by the CUSTOMER of the present general conditions of sale which have a contractual value. By ordering an article on the Site, the CLIENT declares and acknowledges having read, understood, and accepted these general conditions of sale.

"Canergie Shop" reserves the right to modify the general conditions of sale at any time. The general conditions of sale applicable to the CLIENT will be those submitted to him at the date of the CLIENT's order.

ARTICLES

The articles offered for sale on the Site are those that appear on the Site on the date of the consultation of the Site by the CLIENT, within the limit of the available stocks. Due to tight-flow inventory management, "Canergie Shop" does not guarantee the availability of the articles presented on the Site. In case of unavailability at the time of the order, the CLIENT will be informed by "Canergie Shop".

The articles are presented on the Site with the greatest accuracy possible. Nevertheless, the photographs illustrating the articles proposed for sale have only an indicative value because of the alterations which may exist due to their representation on the Site.

PRICE

The prices indicated on the Site are firm and final. They are expressed in Canadian Dollar or USD depending on which currency you will choose, excluding all taxes, in the summary of the order submitted, for acceptance, to the CLIENT. They do not take into account the delivery charges which are invoiced in addition as specified to the CUSTOMER in the summary of the order submitted to him before his acceptance.

The amount of the freight costs is calculated according to the destination and the actual or volumetric weight of the parcel according to the modalities defined by Canergie or the independent carrier chosen by "Xceeed Corp".

Items ordered will be charged at the current price displayed on the Site on the day of the order. " Canergie " reserves the right to modify the prices at any time, without notice, and without any other formality than to carry the modifications on the Site.

Promotional discounts do not apply for purchases before the date of promotions.  Therefore no price matching is applicable for orders out of the period of promotions.

ORDER

A guided navigation allows the CUSTOMER to find on the Site a selection of the articles of the " Xceeed Corporation " collection and then to make his choice from this selection in order to place his order.

Once the choice of the articles has been made by the CUSTOMER, its order is carried out in three stages:

  1. Validation of the articles chosen for purchase by the CLIENT: the CLIENT validates the list of articles that he has chosen on the Site. " Canergie " informs the CLIENT of the availability of the selected articles.
  2. Identification of the CUSTOMER: the CUSTOMER enters the identification and information elements necessary for the smooth running of the order, namely the following elements: name, first name, full contact details, billing address. To this end, the CUSTOMER creates a "personal account" identified by his e-mail address and a password that he chooses and that he agrees to (i) keep strictly secret, (ii) not disclose to third parties in any form whatsoever and (iii) use only in a personal capacity. Any order placed using the CUSTOMER ID and password is assumed to be the CUSTOMER's action. If the CUSTOMER already has a personal account, he will then have to log into his account by entering his e-mail address and password. It will have to update or modify, if necessary, the information resumed.
  3. Validation of the command: a summary of the CLIENT command is displayed on the screen. This summary recalls the selection of the selected and available items, the billing and delivery addresses of the articles, the total price of the said articles as well as the transport and delivery costs relating thereto.

The CUSTOMER checks the summary of his order and can make any modifications he deems necessary. Once a change is made by the CLIENT, a new summary of its modified order is presented to it.

In order for the CLIENT's order to be validated, the order summary must be definitively accepted by the CLIENT by clicking on the "validate" button.

These general terms and conditions of sale are then submitted to the CUSTOMER so that he can read them, if necessary, print them and accept them. Acceptance of these general conditions of sale by clicking on the "accept" button will be the final validation of the CLIENT's order.

The CLIENT is then directed to the secure site of the partner bank of " Xceeed Corporation " to proceed to the payment of his order. Upon receipt by Canergie of the confirmation of payment, notified by its partner bank, the sale will be deemed concluded. The CLIENT's order will then be confirmed by e-mail addressed by " Xceeed Corporation ".

" Canergie " will then prepare the CLIENT's order as soon as possible and inform the CUSTOMER of the expedition of this one by e-mail.

" Canergie" reserves the right to refuse any order or any delivery in the event of partial or total payment delinquency of a previous CLIENT order, litigation in progress with a CLIENT, refusal of authorization of payment of CLIENT Or for any other reason.

PAYMENT

Payments are made in Canadian dollars, exclusively on the secured site of the partner bank of “Xceeed Corporation”.

The payment is made exclusively by bank card VISA, MASTERCARD. If payment is made by means of a VISA card, MASTERCARD, the CUSTOMER must provide the card number, expiry date and the visual cryptogram (the last three numbers on the back of the credit card). *Aditional Fees and Charges may apply on amounts over accepted limit.

The CUSTOMER bank account is debited from the delivery for the amount in Canadian Dollars expressed on the day of the order in the summary that it has accepted.

For deliveries outside the North America area, customs, exchange and other bank charges will be at the exclusive charge of the CLIENT. For more information, "Xceeed Corporation" invites the CUSTOMER to inquire at the bank issuing the bank card used for payment and the competent customs services.

DELIVERY

The articles are delivered by a specialized national carrier or any other independent carrier chosen by "Volts Energies" within an average period of 1 to 8 working days in Canada and within an average period of 3-15 working days, depending on the country of destination. These deadlines are given for information only. The reimbursement of payment terms by " Xceeed Corporation ", nor give rise to a termination of the contract or indemnity for the benefit of the CLIENT.

The articles are transported at the risks and perils of the CLIENT who must check their good condition at the time of delivery. Any anomaly concerning the delivery (damaged packages, missing articles in relation to the " Xceeed Corporation " invoice, etc ...) must be subject to reservations made on the delivery receipt presented by the carrier. The CUSTOMER must simultaneously inform the carrier of this anomaly by sending him a registered letter with acknowledgment of receipt setting out the said complaints within 7 days of the delivery date, which must be substantiated and accompanied by supporting documents.

The CLIENT must send a copy of this letter to "Xceeed Corporation" at the following address within 7 days of the delivery date: "Xceeed Corporation, 1250 Av. Therese Lavoie Roux #309 , Montreal, QC H2V 0B2".

After these deadlines and failing to comply with these formalities, the articles will be deemed to be compliant and free from any apparent defect and no claim can be validly accepted by "Volts Energies".

In case of non conformity of a delivered article, the CLIENT must indicate on his customer account the return of the product, and can return it to "ENTREPOT" to the following address: "Xceeed Corporation, 1250 Av. Therese Lavoie Roux #309 , Montreal, QC H2V 0B2”, in its original condition, must be accompanied by the original packaging and the invoice, otherwise, "Xceeed Corporation" will not exchange or refund the original Defective item returned.

In the event that the return of the defective item is well founded, " Canergie " will, at the option of the CLIENT, or in the absence of a CLIENT's request, at the choice of " Volts Energies " Defective article or its exchange insofar as this article is available in stock, excluding any compensation.

By signing the delivery note, the customer accepts the products delivered as is and therefore no claim relating to damages sustained during the transport will be accepted. It is the responsibility of the customer to carry out all checks and make detailed reserves on arrival of the equipment and to exercise any recourse against the carrier, if any.

ATTENTION: No claim to the carrier can be made after the delivery if the latter has been accepted by the customer. It is therefore imperative to carry out a complete verification of delivery in the presence of the carrier and to refuse delivery if it is the subject of apparent or suspected damage or theft. In case of doubts or damages found or proven, we advise you to refuse the delivery purely and simply.

CLAIMS

All units are carefully packed and inspected before delivery to the carrier. Our responsibility ceases at the moment of the pickup made by the carrier. In case of leak, break or loss of goods, any claim must be filed with the authorized carrier. If, at the time of order, the customer does not take the insurance for its package, xceeed Corporation cannot be held responsible for any damage that has occurred during transportation and the customer must contact the shipping company.

TERMS RETURN MERCHANDISE

RETURNS:

If the items received do not satisfy the CUSTOMER, the CUSTOMER has a period of 14 (fourteen) days following the reception of the order to return its articles.

A RESTOCKING FEE of %25 will be applied to the order. It is sufficient for the CUSTOMER to return the item (s) he wishes to return to their original state, necessarily covered with original labels and accompanied by the original packaging and the invoice, to the following address "Xceeed Corporation, 1250 Av. Therese Lavoie Roux #309 , Montreal, QC H2V 0B2 ".

Shipping costs for returned items are the responsibility of the CUSTOMER unless the items delivered are not in conformity with the order or are the object of visible defects. 

It is up to the CUSTOMER to keep all the proofs of this return (shipping followed by recommended type). These documents must contain the following information: address of the consignee, date of shipment, and the number of packages.

WARNING: any return of goods requires the prior agreement of the company xceeed Corporation and obtaining a return number issued by it to the customer, which must be very clearly legible and visible on any returned parcel.

Returns are to be made in their original state, never used and complete (packaging, accessories, leaflet, etc.) enabling them to be re-branded as new and accompanied by a copy of the purchase and / An RMA return number issued by our services.

Shipping costs for any repairs rather than those damages because of delivery issues are the responsibility of customers.

CANCELLATIONS

Must be in writing and acknowledged by our Department of Customer Service and is subject to restocking fees.

RESPONSIBILITY

"Xceeed Corporation" is only bound by an obligation of means. The CUSTOMER remains the sole judge of suitability and adapted to his needs and consumption of the items he commands. "Xceeed Corporation" can not be held liable for the use of articles not in conformity with their destination. Without limiting the scope of the other provisions of these general conditions of sale, the liability of "Xceeed Corporation" can be retained only in case of proven fault attributable exclusively to it. In any event, it shall be limited to direct damage only.

FORCE MAJEURE

All events, of any nature whatsoever, beyond the control of "Xceeed Corporation", irresistible, unpredictable and tending to delay or prevent the execution of the order constitute a cause of suspension and / or extinction Of the obligations of " Canergie " towards the CUSTOMER, without indemnity for the benefit of the CLIENT. Without limiting the scope of the other provisions of these general terms and conditions of sale, the liability of " Canergie " cannot be incurred for acts resulting from a fortuitous event or from a third party or the victim of the damage.

INTELLECTUAL PROPERTY

The intellectual property rights attached to the items sold on the Site are and remain the exclusive property of the company "Xceeed Corporation". All rights of exploitation are exclusively reserved to him.

In these conditions, no one is allowed to reproduce, exploit, disseminate or use for any reason whatsoever, even partially, the said intellectual property rights, without the prior written consent of " Xceeed Corporation ". The trademarks and logos of the company " Xceeed Corporation " are registered trademarks. Any reproduction is therefore an infringement.

PASSWORDS AND ACCOUNTS

You are responsible for maintaining the confidentiality of the password used to access your account and for restricting access to your computer. Volts Energies is under no obligation to verify the identity or actual authority of any user of a password or user name. Xceeed corporation may rely on the authority of whoever accesses your account or uses your password and will not be liable for any damages or expenses arising out of or in connection with the unauthorized use of such account or word past.

You agree to be responsible for any activity occurring in your account. You agree to immediately notify Volts Energies if the confidentiality of your account or password is compromised. Xceeed Corporation is entitled to take such actions as it deems reasonable in such circumstances, taking into account that it will not be liable for any act or omission in this regard.
